Agency Workers Regulations and Compliance at JSA
JSA has a long history of placing compliance at the centre of everything we do as a business. Having served 50,000 contractors over the last 21 years and been audited on numerous occasions by HMRC we take compliance very seriously. As one of the founding members of the Service Providers Association and annually audited by Professional Passport we understand the importance for both staffing agencies and contractors to know JSA is compliant.We regularly take part in discussions with HMRC regarding upcoming legislation.
The Agency Workers Directive (AWD) will come into effect in October 2011 and is likely to result in significant changes for agencies, umbrella companies and the freelance contractors who work through them.
The legislation allows for equal pay rights, including holiday and certain bonuses, for agency workers in comparison to their directly hired colleagues after a period of twelve weeks. In addition there will be equal opportunity to take advantage of certain facilities, such as a car parking space or canteen, as well as having the same right to apply for a permanent vacancy in the company they are temporarily placed in.
There continues to be much speculation about what this actually means for the agency, umbrella company or contractor. Andrew Goodman, Chairman JSA Services, believes that this presents an opportunity to promote positive change in the industry:
